1. Acceptance of Terms

By accessing or using the RecogniSKILL website and services, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you must not use our website or services.

We reserve the right to update these terms at any time. Continued use of our services after changes constitutes acceptance of the updated terms.

2. Description of Services

RecogniSKILL provides education consultancy services including:

• RPL (Recognition of Prior Learning) facilitation and guidance

• Study abroad advisory and university application assistance

• Visa processing support and document preparation

• RTO compliance consulting for Australian training organisations

• Educational technology platforms and assessment tools

All services are provided on a professional consultancy basis. Outcomes depend on various factors outside our control, including university admission decisions, visa processing by government authorities, and RTO assessment decisions.

3. Not a Registered Training Organisation (RTO)

IMPORTANT: RecogniSKILL Pty Ltd (ABN: 66 666 375 819) is an education facilitator and aggregator. We are NOT a Registered Training Organisation (RTO).

We do not:

• Issue qualifications or certificates

• Conduct RPL assessments or skills assessments

• Determine RPL eligibility or assessment outcomes

• Provide formal training or education courses

• Guarantee qualification issuance

Our role is to connect individuals with accredited RTOs who provide these services. All qualifications are issued by independent RTOs, and all assessment decisions are made by qualified RTO assessors.

4. RPL Eligibility Quiz Terms

Our RPL Eligibility Quiz is provided for general guidance purposes only:

• Not Professional Advice: Quiz results are indicative only and do not constitute professional advice, assessment, or guarantee of RPL eligibility.

• No Guarantee: Quiz results do not guarantee that you will be eligible for RPL, that an RTO will accept your application, or that you will receive a qualification.

• Anonymous: The quiz is designed to be anonymous. No personal identifying information is collected unless you voluntarily submit a contact form.

• Local Storage: Quiz responses are stored in your browser's localStorage. We do not have access to your individual quiz responses.

• Definitive Assessment Required: Only an accredited RTO can provide a definitive assessment of your RPL eligibility. This quiz cannot replace a professional assessment.

• Accuracy: Results are based on the information you provide. We are not responsible for inaccurate results due to incorrect or incomplete information.

5. User Obligations

You agree to:

• Provide accurate, complete, and current information in all interactions with us

• Not use our website for any unlawful purpose or in violation of applicable laws

• Not attempt to gain unauthorised access to our systems or interfere with website operations

• Not misuse our intellectual property or reproduce our content without permission

• Understand that quiz results and general guidance are not substitutes for professional advice

You are responsible for maintaining the confidentiality of any account credentials provided to you.

6. Intellectual Property

All content on the RecogniSKILL website, including text, graphics, logos, images, software, and design elements, is the property of RecogniSKILL Pty Ltd or its licensors and is protected by applicable intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works from our content without explicit written permission.

Quiz results generated through our RPL Eligibility Quiz are for your personal use only and may not be sold, redistributed, or used for commercial purposes without our consent.

7. Fees & Payments

Our RPL eligibility quiz, initial consultation, and general guidance are provided free of charge with no obligation.

Specific processing services, coaching programmes, and compliance consulting are subject to separate fee schedules provided to you before engagement.

All fees will be clearly communicated in writing before any work commences. We operate on a transparent fee model with no hidden charges.

RPL assessment fees are set by individual RTOs. We do not control or receive payment for RPL assessments.

8. Limitation of Liability & Disclaimers

No Guarantees: RecogniSKILL provides advisory and consulting services but does not guarantee specific outcomes, including but not limited to:

• RPL eligibility or assessment outcomes

• Qualification issuance by RTOs

• University admissions or visa approvals

• Accuracy of quiz results or general guidance

• Specific timeframes or costs for RPL processes

RPL Quiz Disclaimer: Our RPL Eligibility Quiz provides general guidance only. We expressly disclaim all liability for:

• Decisions made based on quiz results

• Inaccurate results due to incorrect user input

• RTOs declining RPL applications

• Users undertaking RPL when not suitable

Third-Party Services: We are not liable for the actions, omissions, or services of third-party RTOs, universities, or government agencies.

To the maximum extent permitted by law, RecogniSKILL shall not be liable for any indirect, incidental, consequential, or punitive damages arising from the use of our services, website, or quiz.

Our total liability for any claim arising from our services shall not exceed the total fees paid by you for the specific service giving rise to the claim, or $100 AUD if no fees were paid.

9. Privacy & Data

Your use of our services is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information.

By using our services, you consent to the collection and use of your information as described in our Privacy Policy.

Quiz Data: Quiz responses are stored locally in your browser. We do not collect or store quiz responses on our servers unless you voluntarily submit a contact form or request a referral.

10. Termination

We reserve the right to terminate or suspend access to our services at any time, without prior notice, for conduct that we believe violates these terms or is harmful to other users, third parties, or our business.

You may discontinue use of our services at any time. Any fees paid for services not yet rendered will be handled according to our refund policy.

Quiz data stored in your browser can be deleted at any time by clearing your browser's localStorage for recogniskill.com.

11. Governing Law

These Terms of Service are governed by the laws of New South Wales, Australia.

Any disputes arising from these terms shall be resolved through good-faith negotiations. If a resolution cannot be reached, disputes shall be submitted to the exclusive jurisdiction of the courts of New South Wales, Australia.
